Terms and conditions of the "Saint Body" online shop
§ 1 General provisions
These Terms and Conditions set out the rules for entering into sales contracts via the online shop available at www.saint-body.com, conducted by:
Saint-Body Limited Liability Company with registered office in Warsaw, entered in the Register of Entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw, 12th Commercial Division of the National Court Register under the number 0000618297, share capital PLN 5,000, NIP 525-265-98-47, REGON 364476858.The Terms and Conditions are an integral part of the sales contract concluded between the Seller and the Customer.
All product prices indicated in the Online Shop are expressed in Polish zloty (PLN) and include VAT.
The product information posted in the Online Shop is an invitation to conclude a contract (pursuant to Article 71 of the Civil Code).
§ 2 Definitions
For the purposes of the Regulations, the following terms shall be used:
Registration form - a form available in the Shop for creating an Account.
Order Form - an electronic service that enables the Customer to place an Order (adding a Product to the shopping basket and defining the terms and conditions of the Sales Contract).
Customer - a natural person, a legal person or an organisational unit without legal personality, to which legal capacity is granted by law, placing an Order in the Store.
Consumer - a natural person who makes a legal transaction with an entrepreneur which is not directly connected to his/her commercial or professional activity.
Account - a set of resources in the Seller's system, marked with a login and password, where the Customer's data and information about his/her Orders are stored.
Product - a movable item which is the subject of a sales contract between the Seller and the Customer.
Regulations - this document.
Online shop - shop operated by the Seller at www.saint-body.com.
Sales Contract - contract of sale of a Product concluded between the Seller and the Customer through the Shop.
Order - the Customer's declaration of intent made via the Order Form aimed at concluding the Sales Agreement.
§ 3 Electronic services
The following electronic services (free of charge) are available in the Shop:
a) Account
b) Order FormThe Order Form service is provided on a one-off basis - it expires when the Order is placed or when the form is no longer in use.
The Account service is provided for an indefinite period of time. The Customer may resign from the Account at any time, without giving any reason, by sending an appropriate statement to the Seller.
The service starts in the case of an Account when the registration is confirmed and in the case of an Order when the Customer adds the first Product to the virtual shopping basket.
§ 4 Placing an order
The shop accepts Orders 24 hours a day, all days of the week. Orders placed on Saturdays, bank holidays or public holidays will be processed on the next working day.
An order can be placed without permanent registration - by selecting "purchase as a guest".
In order to place an Order, the Customer must perform the following steps:
a) add the Product(s) to your shopping basket,
(b) indicate the data for dispatch,
c) confirm the Order by clicking on the "Order with obligation to pay" button.
The Sales Contract is concluded as soon as the Order is approved.The Customer has the possibility to modify the contents of the shopping cart and the address data before the Order is approved.
The Customer is obliged to provide true and current data. The Seller reserves the right to refuse to process an Order if the data prevents delivery - after contacting the Customer to establish correct data.
The Contract of Sale is concluded in Polish or in English, according to the Customer's choice when placing the Order.
§ 5 Payments
The seller provides the following forms of payment:
a) online payment via the imoje system (ING Bank Śląski),
b) payment via the Stripe system (e.g. Apple Pay), in accordance with the terms and conditions of this system,
c) traditional bank transfer - in case of problems with online payment.The order must be paid for within 48 hours of its placement. Failure to pay within this period shall be treated as withdrawal by the Customer from the contract.
In the case of payment by bank transfer: the Seller's account number is ING Bank Śląski: 50 1050 1012 1000 0092 2617 1388. In the title of the transfer, please give the Customer's name and surname (or company name) and the number of the Order. A confirmation of the transfer should also be sent to the e-mail address: kontakt@saintbody.com.
§ 6 Performance of the contract
Completion of the Order means its preparation for dispatch to the address indicated by the Customer.
In the case of a prepaid payment, the fulfilment can be started after the funds have been credited to the Seller's account.
The Sales Contract shall be deemed to have been executed upon delivery of the consignment to the address indicated.
The lead time for the Order is specified in the Product description.
The Seller shall inform the Customer of acceptance of the Order and of dispatch by e-mail.
§ 7 Cost and terms of delivery
Orders are delivered to the address specified by the customer.
All shipments are insured.
The standard delivery time is approximately 2 working days after dispatch.
In the case of electronic or card payment, the time counts from the crediting of the Seller's account.
§ 8 Withdrawal from the sales contract
The consumer and the trader with consumer status have the right to withdraw from the sales contract without giving any reason within 14 ( fourteen ) days from the conclusion of the contract.
The period for withdrawal shall expire after 14 days from the day on which the Customer took possession of the Product or a third party (other than the carrier) took possession of the Product.
To exercise the right of withdrawal, the Customer must inform the Seller of his decision in writing or electronically.
Following notification of withdrawal, the Customer shall be obliged to return the Product without delay and in any event not later than 14 days from the day on which he or she notified the Seller of the withdrawal.
The Customer shall bear the direct costs of returning the Product.
The payment will be refunded within 14 days of receipt of the return parcel by the Seller.
Payment will be refunded by the same method used by the Customer - unless the Customer agrees to a different method of return that does not incur a cost to the Customer.
Product DamageIf the returned Product bears traces of damage caused by the Customer (e.g. excessive use, permanent stains, damage to the material), the Seller has the right to reduce the amount of the refund in proportion to the loss of the Product's value or - in extreme cases - to refuse a full refund. The Customer is obliged to secure the returned Product in a manner ensuring its intactness until it is collected by the Seller.

§ 9 Liability for defects
The Seller shall be liable for the fact that the Product sold to the Customer is free from physical or legal defects.
Warranty claims for defects are governed by the provisions of Article 556 et seq. of the Civil Code.
A product that has a defect discovered within 2 years of its issue may be claimed by the Consumer.
Complaints should be submitted to the following address: Saint-Body Sp. z o.o., Żurawia Street 2/43, 00-503 Warsaw. The Seller undertakes to examine the complaint within 14 days from the day of receiving the parcel with the product complained about.
§ 10 Out-of-court complaint and redress procedures
The consumer has the right to use mediation by the competent authorities, including:
requesting mediation proceedings from the Provincial Inspector of Trade Inspection,
Referral of the case to the Permanent Consumer Arbitration Court operating at the WIIH,
seeking assistance from the Municipal Consumer Ombudsman.
The consumer can also use the ODR (Online Dispute Resolution) platform in accordance with Regulation (EU) No 524/2013.
§ 11 Protection of personal data
The administrator of the Customer's personal data is the Seller.
By placing an Order or registering an Account, the Customer consents to the processing of his/her personal data for the purpose of concluding and performing the contract.
Data may also be processed for marketing and promotional purposes with the prior consent of the customer.
The customer has the right to access, correct or delete their data at any time.
§ 12 Privacy policy
The administrator of the personal data is the Seller.
The data provided by the Customer is used exclusively for the operation of the Online Shop and is not disclosed to third parties, with the exception of entities to which disclosure is necessary for the performance of the contract (e.g. the carrier).
The shop uses cookies to make the website work better.
§ 13 Final provisions
Matters not covered by these Terms and Conditions shall be governed by the applicable laws of the Republic of Poland, in particular the Civil Code and the Consumer Rights Act.
Graphic material, texts and product photos available at www.saint-body.com are protected by copyright. Copying or distributing them without the permission of the Seller is prohibited.
The Terms and Conditions are effective as of the date of their publication on the Shop website.
